SH Helper AI Terms of Service

Welcome to SH Helper AI. These specialized Terms of Service ("AI Terms") govern your access to and use of the artificial intelligence features, chatbots, generated content, and associated services (collectively, the "AI Services") provided by SH Helper.

By accessing, interacting with, or otherwise using the AI Services, you explicitly agree to be bound by these AI Terms, in addition to our general Terms of Service and our AI Privacy Policy. If you do not agree to these terms, you must immediately cease all use of the AI Services.

1. Age Restrictions & Eligibility

You must be at least 18 years of age to access and use the SH Helper AI Services. By using the AI Services, you represent and warrant that you meet this age requirement. We do not permit individuals under 18 to use the AI Services.

2. Third-Party AI Models

SH Helper AI operates by utilizing robust third-party artificial intelligence models and application programming interfaces (APIs). Specifically, our systems integrate with models provided by Google (Gemini models) and Groq.

By using our AI Services, you acknowledge that your prompts and data are processed by these underlying third-party providers. You agree that SH Helper acts as a facilitator, and you are also subject to the usage policies and terms established by these third-party model owners (Google and Groq). We make no claims of ownership over the base models themselves, and all underlying model rights remain with their respective corporate owners.

3. Intellectual Property Rights & Content Ownership

3.1. Complete User Ownership of Outputs

We believe in empowering our users. Therefore, as between you and SH Helper, you retain 100% ownership of both the text/prompts you submit (Inputs) and the content generated by the AI in response (Outputs), strictly within the context of the AI page.

Whether the generated content is highly usable, commercial, or even if it turns out to be harmful or inappropriate (despite our safety filters), the ownership and the ultimate responsibility for that content rests solely with you, the user. SH Helper claims no intellectual property rights over the Outputs generated during your session.

3.2. Platform Rights

While you own the generated Outputs, this ownership applies exclusively to the content generated within the AI interface. It does not grant you any rights over the SH Helper platform's design, code, branding, or the underlying AI models provided by Google and Groq.

4. Safety, Prohibited Use & Absolute Disclaimer of Liability

While we impose no strict usage limits (rate limits) at this time, you agree to adhere to common-sense safety rules. You are strictly prohibited from using the AI Services to:

• Generate, promote, or facilitate illegal acts, violence, terrorism, or the exploitation of minors.
• Create, distribute, or execute malicious software, ransomware, viruses, or any code designed to disrupt computer systems.
• Generate fraudulent schemes, phishing attempts, spam, or misleading impersonations.
• Attempt to "jailbreak," bypass, reverse engineer, or override the safety filters or system prompts of the AI Services.

If you violate these terms, we reserve the right to immediately and permanently ban your account.

5. Data Privacy & Ephemeral Mode

Your privacy is paramount. The collection, storage, and utilization of your conversational data are governed strictly by the SH Helper AI Privacy Policy.

Strict Ephemeral Guarantee: We explicitly guarantee that if you disable the "Activity" setting within your account, your data is processed entirely ephemerally. In this state, strictly 0 bytes of your conversational data are saved to our servers. No temporary logs, no debug traces, and no hidden databases will store your prompts or the AI's responses.

6. Disclaimer of Warranties

THE AI SERVICES ARE PROVIDED STRICTLY ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SH HELPER DISCLAIMS ALL WARRANTIES. DUE TO THE NATURE OF AI, WE DO NOT WARRANT THAT THE AI SERVICES WILL BE ERROR-FREE, SECURE, OR FREE FROM HALLUCINATIONS (INACCURATE FABRICATIONS). YOU EXPLICITLY AGREE THAT YOU WILL NOT RELY ON THE AI FOR MEDICAL, LEGAL, OR FINANCIAL ADVICE.

7. Comprehensive Indemnification (Bharpai)

By using the AI Services, you agree to assume full responsibility for your actions. You agree to unconditionally defend, indemnify, and hold harmless SH Helper, its founders, affiliates, and their respective officers from and against any and all claims, liabilities, damages, lawsuits, financial losses, or expenses (including legal fees) arising out of or relating to:

• Content Creation: Any harmful, illegal, or destructive content you generate and distribute using the AI.
• Actionable Advice: Any injuries, financial losses, or damages incurred because you or a third party acted upon advice (medical, financial, coding, or legal) generated by the AI.
• Copyright Infringement: Any claims by third parties (including Google, Groq, or other copyright holders) that the content you generated or published infringes upon their intellectual property rights.
• Misuse & Hacks: Any damages resulting from your attempts to jailbreak the AI, inject malicious prompts, or bypass system safety measures.

In simple terms: If your use of the AI causes harm or results in a lawsuit against SH Helper, you are legally and financially obligated to cover all costs and damages.

8. Modifications to the AI Terms

SH Helper reserves the right, at its sole discretion, to modify, amend, or replace these AI Terms at any time. When we make material changes to these terms, we will actively notify you by sending an update directly to your registered email address. Your continued use of the AI Services following such email notification means that you accept and agree to the updated changes.

9. Governing Law and Jurisdiction

These AI Terms and your use of the AI Services shall be governed by and construed in accordance with the laws of the Republic of India, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising under these AI Terms will be brought exclusively in the competent courts located within India, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
